Did you make any payment into a Spanish bank towards the purchase of an off plan property either in Spain or abroad? The development was never finished? They finished it but late? The Spanish Supreme Court ruled on the 21st December 2015 (Sentencia TS (Sala 1.ª) de 21 diciembre 2015) that in case of properties off plan ruled by the law 57/1968 (off plan properties), banks that take payments from purchasers will be held responsible to refund the amounts paid, in case the developer does not deliver the property according to the conditions of the purchase agreement.

This establishes a precedent that can be applied to any amounts paid into a Spanish bank towards the purchase of a property off plan, whether in Spain or abroad.

It is very important to emphasize the following aspects:
1.- The above mentioned law only and exclusively applies to payments made into the developer´s bank account in Spain. Payments made abroad cannot be taken into account.

2.- Every case must be studied and taken to court individually. The law 57/68 is not straight forward and therefore, to be applied, many other aspects must be defended and supported before the court. For example, we will need to prove amongst others, that the purchase was not made by an investor but, by a purchaser/client, being the latest understood as a person who buys the property for his/her own joy, and not for speculative purposes.

3.- Furthermore, we do not recommend you to submit your case to the court in a group. In case the tribunal does not rule in your favor, you can always appeal, that is right. However, you will not be able to submit your case to a court again, as the “res judicata principle” or “double jeopardy principle”, rules Spanish Procedural Law.
